Liability insurance:

Lawyers are obliged by the Federal Lawyers’ Act (Bundesrechtsanwaltsordnung) to maintain professional liability insurance with a minimum sum insured of € 250,000. The details can be found in § 51 BRAO. As a lawyer, I am insured with HDI Versicherung AG, Customer Service, 30650 Hanover. The territorial scope of the liability insurance is the entire EU territory and the states of the Agreement on the European Economic Area. Excluded from this are

– pursuant to section 51 sub-section 3 line 2 BRAO, claims for damages arising from activities through law firms or offices established or maintained in other countries
– pursuant to section 51 sub-section 3 line 3 BRAO, claims for damages arising from activities in connection with the provision of advice and dealing with non-European law, and
– pursuant to section 51(3)(4) BRAO, claims for damages arising from activities of the lawyer before non-European courts.

In the event of disputes between lawyers and their clients, there is the possibility of out-of-court dispute resolution upon application to the regional bar association in Hamm (pursuant to § 73 Para. 2 No. 3 in conjunction with § 73 Para. 5 BRAO) or to the conciliation board of the legal profession (§ 191f BRAO) at the Federal Bar Association, which can be found on the internet via the homepage of the conciliation board of the legal profession (www.s-d-r.org).
